No purchase necessary
AllStar Fundraiser campaigns are designed to be no purchase necessary sweepstakes. A donation or other payment is not required to receive a ticket or to enter. Individuals who prefer not to donate must be offered an alternative free method of entry by the participating nonprofit organization, and free entries must have the same odds of winning as paid or donation-based entries.
Who operates the campaign
AllStar Fundraiser, LLC (“AllStar”) provides software and administrative tools to help eligible nonprofit organizations manage fundraising campaigns that include no-purchase-necessary sweepstakes. AllStar is a software and administrative services provider. AllStar is not the charitable recipient, solicitor, sponsor of any individual nonprofit campaign, or prize administrator unless expressly identified in the official rules for a specific campaign.
Each participating nonprofit organization is the sponsor of its own campaign unless the official rules for that campaign state otherwise. The nonprofit organization is solely responsible for:
- determining whether it is legally eligible to conduct the campaign in the jurisdictions where it promotes the campaign;
- distributing tickets and administering any free method of entry;
- collecting and handling contributions or donations;
- prize fulfillment unless otherwise stated in its official rules;
- donor, tax, charitable solicitation, gaming, and reporting compliance; and
- all advertising and promotional activities for its campaign.
Who may use the platform
AllStar licenses its software only to organizations that represent that they are nonprofit organizations and that they are legally authorized to conduct the fundraising and promotional activities they choose to run through the platform.
How tickets work
Before each campaign period, AllStar generates tickets using randomized processes. Ticket assignments are created using randomization logic designed to produce unique ticket combinations for that campaign. The exact structure of a ticket, including the number of weekly contest opportunities, prize amounts, tie rules, and winner-determination methodology, is governed by the official rules for the specific campaign.
For the standard NFL regular-season campaign format:
- each ticket contains 18 unique weekly team combinations, one for each regular-season contest week used by the campaign;
- each weekly combination represents one separate chance to win for that week;
- each ticket within the campaign is intended to be unique; and
- the winning combination(s) are determined according to the official rules.
How winners are determined
For each weekly contest, the teams listed on a ticket are assigned points based on the scoring outcomes described in the official rules. Prize winners are determined by comparing the total points of the ticket’s weekly combination against all valid entries for that week, subject to the campaign’s prize structure, tie rules, eligibility rules, and other official rules.
Official rules control
The ticket is a summary only. The official rules for the specific campaign control in the event of any conflict or ambiguity. Each ticket should direct entrants to the official rules page for the campaign sponsor, which should include at minimum:
- sponsor name and contact information;
- eligibility and geographic restrictions;
- start and end dates;
- free method of entry instructions;
- prize descriptions and approximate retail value, if applicable;
- odds language or method of calculating odds;
- winner determination and tie procedures;
- claim procedures and deadlines;
- tax and documentation requirements; and
- any void jurisdictions or additional restrictions.
Free entry requirement
Participating organizations must provide a genuine free method of entry that:
- does not require a donation, purchase, or payment;
- is available during the campaign entry period;
- results in entry into the same drawing or prize opportunity;
- provides the same odds of winning; and
- is described in the campaign’s official rules.
Taxes
Winnings may be taxable. Campaign sponsors are responsible for complying with all applicable tax reporting and withholding obligations, and winners may be required to provide taxpayer identification information and execute affidavits, releases, or other documentation before receiving a prize.
Marketing communications
Entry in a campaign does not by itself require consent to receive promotional or marketing communications, except for communications necessary to administer the campaign or as otherwise permitted by law. Any optional marketing consent should be obtained separately through a clear affirmative opt-in where required.
Jurisdiction matters
Laws governing sweepstakes, charitable fundraising, charitable gaming, solicitation, taxes, and prize promotions vary by jurisdiction. Each nonprofit organization is solely responsible for ensuring that its campaign is lawful in each place where it advertises, distributes tickets, accepts entries, or awards prizes.
